Wrongful termination refers to an instance where an employee is discharged from their employment in a manner that violates specific legal rights or protections. Such violations can include terminations made on the basis of discrimination, retaliation, breach of contract, or violation of public policy, among other forms.
Workplace harassment involves any unwelcome conduct or comments based on disability, sex or gender, race or national origin, religion, pregnancy, age (40 or older), among other characteristics. Harassment becomes unlawful when enduring the offensive conduct becomes a condition of continued employment or the conduct is severe or pervasive enough to create a work environment that a reasonable person would consider intimidating, hostile, or abusive.
Retaliation refers to adverse actions taken by employers against employees for engaging in legally protected activities. This can include actions such as filing a complaint of discrimination, participating in an investigation or lawsuit, whistleblowing on unlawful practices, or exercising workers' rights. It is important to note that retaliation is unlawful, even if the original complaint turned out to be unfounded, so long as it was made in good faith.
Workplace discrimination refers to unequal treatment of employees based on characteristics such as race, gender, age, religion, disability, sexual orientation, or other protected categories under state and federal laws. Such discriminatory practices could include unequal pay, disparate treatment, unfair promotions or layoffs, or creating a hostile work environment.
Under California law, employees who work more than five hours in a day are entitled to a 30-minute meal break. Those working over 10 hours are eligible for a second meal break. Additionally, employees are entitled to a 10-minute rest break for every four hours worked or major fraction thereof. These breaks are not just a courtesy—they are a legal requirement. If your employer fails to provide these mandated breaks, or pressures you to skip them, you may be entitled to compensation.
